Copyright sa kultura ng Pilipinas isinulong ni Legarda

Nanawagan si Deputy Speaker Loren Legarda na protektahan ang cultural heritage ng bansa matapos ang kontrobersiyang kinasasangkutan ng pinakamatandang “mambabatok” na si Whang-Od Oggay at vlogger na si Nas Daily.

Si Legarda ay isang advocate para sa pangangalaga ng arts and culture ng bansa.

At upang maiwasan ang posibleng pag-abuso at pagsasamantala sa cultural heritage, naghain siya ng House Bill 7811 o “An Act Safeguarding the Traditional Property Rights of Indigenous Peoples”.

Layunin ng panukalang batas na lumikha ng isang komprehensibong cultural archive at nag-uutos ng pagbabayad ng royalty para sa paggamit ng cultural property ng mga indigenous people.

“To prevent possible abuses or the exploitation of our cultural heritage, this bill hopes to fill in the gaps and apply the conventional forms of intellectual property, like copyright, royalty, and ownership. It has broader coverage for royalties that will compensate communities for their collective and individual creative expression and extends intellectual property rights past 50 years,” paliwanag ni Legarda.

Ani Legarda, dapat kumuha si Nas Daily ng basbas mula sa Butbut community, na ancestral birthright ng pagta-tattoo sa Kalinga, kung saan miyembro si Apo Whang-Od.

“Nas Daily should have gone through the process of seeking consent from the community, as stipulated under the Indigenous People’s Rights Act, considering that the art form is considered communal traditional knowledge,” aniya.
